Terms of Service

1. Acceptance & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you and ATOMIC.LIMITED ("we," "us," "our"), the operator of SportixArena.

By accessing or using SportixArena (the "Platform"), you confirm that:

• You are at least 16 years of age
• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws

If you use the Platform on behalf of a company or organisation, you warrant that you are authorised to bind that entity to these Terms.

2. The Platform

SportixArena is a sports booking and community platform that enables users to:

• Discover and book sports courts and facilities ("Venues")
• Join or create open games ("Let's Play")
• Book coaching sessions with registered coaches
• Access flash deals for last-minute availability
• Track padel performance via PadelVision AI integration
• Interact with a sports community feed

We act as a marketplace connecting users with venues, coaches, and other players. We are not a venue operator or a coach, and are not responsible for the quality or safety of third-party services accessed through the Platform.

3. Accounts

You must create an account to access most Platform features. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials confidential
• Notify us immediately of any unauthorised account access at support@atomic.limited
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice, where necessary to protect the Platform or other users.

4. Bookings & Payments

When you book a court or coaching session through SportixArena:

• A binding booking contract is formed between you and the venue or coach — not with ATOMIC.LIMITED
• Payment is processed securely by our PCI-DSS certified payment partner at the time of booking
• A booking confirmation will be sent to your registered email and visible in the app
• Prices are displayed in the local currency (AED, SAR, or GBP) and are inclusive of any applicable service fees
• Flash Deal prices are only valid for the duration specified; expired deals are not honoured

Loyalty points are awarded at our sole discretion and are not redeemable for cash.

5. Cancellations & Refunds

Our standard cancellation policy is as follows. Individual venues may have stricter policies, which will be displayed before you confirm your booking:

• More than 24 hours before the session: Full refund to original payment method
• Between 6 and 24 hours before: 50% refund or venue credit (venue discretion)
• Less than 6 hours before or no-show: No refund

For coaching sessions, cancellation policies are set by the individual coach and displayed before booking.

In exceptional circumstances (e.g., venue closure, medical emergency with documentation), we will review refund requests on a case-by-case basis. Contact support@atomic.limited.

6. Let's Play & Group Bookings

Let's Play allows users to create and join open sports games. When using this feature:

• The game organiser is responsible for the booking contract with the venue
• Cost-splitting is calculated automatically based on the number of confirmed players
• If a player cancels and the minimum player count is not met, all confirmed players will be notified and offered a refund at the organiser's discretion
• SportixArena is not responsible for disputes between players regarding skill level, conduct, or attendance

7. Community Feed

The Community Feed allows users to share sports-related content. By posting content, you:

• Warrant that you own or have the right to share the content
• Grant ATOMIC.LIMITED a non-exclusive, royalty-free licence to display and distribute your content on the Platform
• Agree not to post content that is offensive, defamatory, discriminatory, illegal, or unrelated to sports

We reserve the right to remove any content that violates these Terms or our Community Guidelines, and to suspend users who repeatedly violate them.

8. Coaches

Coaches listed on the Platform are independent professionals, not employees or agents of ATOMIC.LIMITED. We do not guarantee:

• The accuracy of coach credentials or qualifications (though we do conduct verification checks)
• Session quality or outcomes
• Coach availability or reliability

Any disputes regarding coaching sessions should first be attempted to be resolved directly with the coach. If unresolved, contact us at support@atomic.limited.

9. Vendor Responsibilities

Venue operators and coaches ("Vendors") who list on SportixArena agree to a separate Vendor Agreement. Vendors are responsible for:

• The accuracy of venue information, photos, pricing, and availability
• The safety and condition of facilities
• Honouring confirmed bookings
• Complying with all applicable local regulations and licences

ATOMIC.LIMITED is not liable for venue or coach failures. In cases of confirmed venue or coach failure, we will facilitate refunds under our Refund Policy.

10. Prohibited Conduct

You must not use the Platform to:

• Make fraudulent bookings or fake payment transactions
• Harass, threaten, or abuse other users, coaches, or venue staff
• Scrape, copy, or republish Platform content without written permission
• Attempt to access systems or data not intended for you
• Post spam, solicitations, or content unrelated to sports
• Circumvent our payment systems or loyalty programme
• Create multiple accounts to abuse promotions or flash deals
• Impersonate another person or organisation

Violation may result in immediate account suspension and, where appropriate, legal action.

11. Intellectual Property

All Platform content — including the SportixArena name, logo, design, software, and written content — is owned by or licensed to ATOMIC.LIMITED and is protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works from any Platform content without our prior written consent.

User-generated content (posts, reviews, photos) remains your property. By submitting it, you grant us the licence described in Section 7.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• ATOMIC.LIMITED provides the Platform "as is" without warranties of any kind, express or implied
• We are not liable for indirect, incidental, or consequential damages arising from your use of the Platform
• Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim
• We are not responsible for the actions, quality, or safety of venues, coaches, or other users

Nothing in these Terms limits our liability for death, personal injury, or fraudulent misrepresentation.

13. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates. For users in the UK, applicable UK consumer protection law also applies and is not excluded by these Terms.

Any dispute arising from these Terms that cannot be resolved amicably will be referred to the courts of Dubai, UAE, unless mandatory local law in your jurisdiction provides otherwise.

We encourage you to contact us first at support@atomic.limited — most issues can be resolved quickly without legal proceedings.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before they take effect.

Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Platform and may request account deletion.
